FIR over forged sale agreement

10-Dec-2023 (In Criminal Law)
Hi I have a criminal case filed against me for forgery case. The police inquired me and the complainant. The complainant said that I misused a blank stamp paper signed by him and wrote sale agreement on that. The Police did not enquire any witness signed on the sale agreement and filed a chargesheet against me. Can we file a quash petition against this chargesheet and is there any prior judgement where the highest court has said that a Chargesheet cannot be filed without inquiring witness?

The police officials should inquire the witnesses if any in the agreement for sale. And without doing so the police cannot just straight away go for filing of the chargesheet. It's all a matter of arguments in the court when the trial begins. You can always approach the High Court with the quashing petition of the said FIR in question.

This is not a sufficient ground to file quashing, first you need to understand what is the rule of witness, witness verify that both parties have signed in from of them. They have nothing to do with what is written in the deed. Furthermore u can call these witnesses in your Defense at the time of Defense evidences You need to hire expert advocate for your trail Plz be in touch

You should approach the Hon'ble high court to get the FIR quashed by the high court as soon as possible. If there is a delay in approaching the high court, then the court may not consider you quashing petition.
