Fir is lodged but no action taken for last 6 months what to do.

my fir against builder is lodged 6 months before but no action taken by police they keep on saying investigations going on so what is the way out so that police take action and arrest sections are 420,120b,3(32)14 hpdife ag. kindly tell if police not taking action and always give excuses that investigation is going on.

Sir if the FIR has been lodged then the police is under obligation to arrest the builder.. But since builders are influntial there may be some delay.. But the best way to deal with builders is to file a court complaint.. By that court will summon the builder to aapse before court.. I will be able to guide u further properly by meeting

You may file same complaint with d Chief Judicial Magistrate along with an application under Section 156 (3) CrPC praying for direction to the concerned SHO/Police to investigate the case after registeration of the FIR....

File your case against the builder in the consumer Forum, and also file a complaint against the builder the Economic offences wing. Apart from this you can pursue the criminal case also. The Investigation officer has to file his report within 90 days.if he does not do so the magistrate can take direct cognizance.

Hi,

The best remedy is to file petiton under section 482 before the Hon'ble High Court seeking direction. Before filling i would suggest to move a detail representation before higher authority (SP etc), so that high court can direct to decide the representation.

In case the police is not registering the FIR and delaying the investigations, you may approach the court under Section 156(3) of the Code of Criminal Procedure for taking cognisance of your complaint and directing the police to register FIR and immediately carry on the investigation.
