FIR is not compulsory for filing Civil and Criminal Cases in India. Lodging of FIR and lodging of Civil Cases have got no relation with each other. Police lodges FIR in case of Cognizable Offences prescribed in the Law, in which the Jail Punishment is upto 3 years or more than 3 years. If FIR won't get lodged to commence a Criminal Case, then you can lodge a Private Criminal Complaint to seek powers for the Police to either lodge FIR or NC in the case, i.e, to investigate and/or arrest the accused who had committed the offences.

FIR means first information report which is the first step of invitation of a criminal proceedings. For civil matters there is no FIR. FIR has to be filed by the informant/victim himself and not by the advocate.
