31-Jul-2023 (In Criminal Law)
Sir I want to know few details n1 if FIR is compulsory before filling a case in civil and criminal courtn2 can FIR be filed by my advocate on my behalfn3 how effective is online E FIR, how is it different from offline FiR? Other then it can be filed online.n4 in which area the FIR should be filed if complainant live in other state and crime is committed in another one
FIR is not compulsory for filing Civil and Criminal Cases in India. Lodging of FIR and lodging of Civil Cases have got no relation with each other. Police lodges FIR in case of Cognizable Offences prescribed in the Law, in which the Jail Punishment is upto 3 years or more than 3 years. If FIR won't get lodged to commence a Criminal Case, then you can lodge a Private Criminal Complaint to seek powers for the Police to either lodge FIR or NC in the case, i.e, to investigate and/or arrest the accused who had committed the offences.
