FIR filed under section 307 and others


18-Aug-2024 (In Criminal Law)
FIR filed under IPC 307, 386,504,506 in 2019. Police put Final Report. Complainant files protest petition and then court open it for re-investigation by disposing final report by police. Police again put Final Report in 2023. Now matter is pending in court. No action by complainant till yet. Since it is a false FIR and I have the required proofs which I submitted to police. My question is : What can I do now against this complainant as he make false FIR against me?

According to your question presumption is that you are innocent and you have strict proof against the complainant so you have an option to approach Hon`ble High Court where you have to file a petition and Hon ble court will decide it as soon as fast. for better knowledge I have to know more about your case

You may file case of malicious prosecution. You can file case of Criminal defamation against the accused. You can also file case of defamation in civil court and claim damages for the damege taht has been caused on your reputation by this FIR. But before you take any action let the Final report is accepted by the concern magistrate. I would also advice you to consult with your lawyer before taking any action. it's very vital questions you have raised in your case actually once if I are lost and it is quest are final report is in the favour of accused then it can be treated as perjury of the case, you can file a definition case against the component
