FIR filed on 01.06.2016 u/s 447,294-B,323, 506 IPC and filed alteration memo 05.06.2016 u/s 506,294-B,323,354,448 with false allegations by a woman. allegation: unnecessarily I tresspasse into house of complainant by abusing her in most filthy language and beat with hands, kicked with legs over the issue of Tap water and also there is a life threat with me. she modified the above version under 161 CR PC and 164 CRPC that i am sexually harassing her 2 months ago. In the night i used to go to her house (neighbour) for considering sexual request. she filed one case in Human rights commission also on 28.06.2016, but HRC declared that there are no human rights violated. All the witness also stated during the enquiry on 03.06.2016, that I have not tresspassed and not quarrled with her. Since witnesses are not in her favour she approached media and given statements against me. Due to the above police made a false case against me due to the above impact. kindly guide me.

Meet the Inspector of police and explain in detail all that fraud happened to you. If he does not care you, you directly meet the DCP/SP and explain the situation. If the witnesses are in your favour, nothing will happen.

face the trial to prove your innocence before court of law.


At this juncture, you need to appoint an advocate to contest the said false case as per you. However, such advices should not be sought from us, as the matter is under prejudice.

Since most of witnesses are in your favour, you can easily win the case during trial.
Generally high courts used to quash such false cases, but now they are not quashing cases without trial.
So better to higher a lawyer and use the Human rights commission report to your advantage and get the case dismissed.
Also in all likelihood, the police also might not have a fool proof case against you as Human rights commission report is to your advantage and hence no worries.
