Either you can file for quashing or file for in the court of Judicial Magistrate first class for discharge which will help you getting discharged from the criminal cases, you can do this for both of your cases but before you need to get a bail from court in both the cases

First collect all documents and evidence showing the falsity contradiction in allegations. you may approach the court for anticipatory bail if there is apprehension of arrest . If a person has earlier filed a complaint against you and again files a false or malicious complaint, the law provides remedies. First, collect all documents and evidence showing the falsity and contradiction in allegations. You may approach the court for anticipatory bail if there is apprehension of arrest. If the complaint is clearly false, vexatious, or an abuse of process, you can file a petition for quashing before the High Court. You may also seek action against the complainant for giving false information, perjury, or malicious prosecution, after the case is examined by the court. Always cooperate with investigation, avoid direct confrontation, and consult a criminal lawyer immediately to protect your rights and reputation.

If a false complaint is filed against you after an earlier complaint under Section 352 BNS, you should first cooperate with the police and place all true facts and evidence on record. You can seek anticipatory bail if there is apprehension of arrest. File a detailed reply and supporting documents before the Investigating Officer and the Magistrate. You may also initiate action for false and malicious prosecution, including proceedings under Sections 211/228 BNS and seek quashing of the FIR/complaint under Section 482 CrPC if it is abuse of process of law.

If a person repeatedly files false or malicious complaints (earlier under s.352 BNS and later again on false facts), you should act legally and calmly. First, cooperate with investigation and place all documentary and electronic evidence showing falsity and motive. You may seek anticipatory bail if there is apprehension of arrest. You can file a counter-complaint for giving false information to police and for malicious prosecution after closure/acquittal. Remedies like filing an application under CrPC/BNS provisions for action against false complainant, seeking quashing before High Court if allegations are absurd, and claiming compensation for false accusation are also available. Repeated false cases weaken the complainant’s credibility.

Response: “Dear [Client Name], If someone has made a complaint against you under Section 352 IPC (assault), and later tries to file a false or fabricated complaint, there are legal remedies to protect yourself: Oppose the false complaint legally: You can file a police complaint under Section 182 IPC (providing false information to public servant) or Section 211 IPC (false charge with intent to cause injury). You can also inform the police that the new complaint is false and provide evidence disproving it. Defend yourself in court: In case an FIR is registered, your advocate can file anticipatory bail or regular bail if needed. Collect all proof, witnesses, CCTV, messages, etc., to show that the allegations are false. Legal Strategy: If the false complaint is malicious, your lawyer may also move for quashing under Section 482 CrPC, especially if it is clear there is no prima facie case. Keep a record of repeated harassment as it can help in both defense and counter-action. Key Advice: Do not ignore any FIR; respond through your advocate. Maintain documentation of all interactions. Acting proactively is important to prevent malicious litigation from harming your rights. Regards, AARS Legal Associates Mumbai
