Father of my daughter in law tried to

10-Oct-2023 (In Criminal Law)
The father of my daughter in law forcibly entered our house with some goons and tried to get physical with me and harassed me sexually and tore of my clothes. I did not register a complaint at the time of incident. It has been 4 years now. Can I file a complaint now? Will they be arrested? Will there be an FIR filed now or police would not register it because it happened 4 years ago? What should I do?

It's too late to lodge an FIR now . Police may refuse file the FIR as there is extraordinary delay in lodging of FIR. There should be a fresh cause of action to proceed. Contact an advocate and tell your facts .

You can file a complaint now, however the cause for not filing it then needs to be specified. Also you would require to disclose the reason for filing the complaint now and the cause of it. For any further clarification feel free to contact Thanks

Greetings to you. Legally there’s no bar in lodging a complaint even after a lot of delay but due to this delay, it’s not going to help you much in trial. You may certainly be able to harass them. If you are expecting that they must be arrested, then under all likelihood , it’s not going to happen except very rarely. If you require any legal assistance, please feel free to reach out to me. Regards.

You can try with the complaint and address it to the police station according to your jurisdiction. And if the police officials failed to register the FIR then you can always file a petition under section 156(3) CrPC for the registration of the same from the court. After that they will be summoned by the court to prove their stand.
