False promise and extortion

A person with a false promise of getting govt job took advanced cheque from me. Even though i am selected on merit, he is threatening to bounce the cheque if i don't pay the money. Also threatening that he would harm my job.

Please issue him a legal notice and let him bounce thereafter he will issue you a notice to pay the cheque amount issue a reply through lawyer there after he may file a cheque bounce case where upon you may receive a summons, you engage a lawyer and get bail and thereafter defend the case, there is no problem for your job, there are ample opportunities even to compromise the matter till the case is at its last stage.

The cheque you have issued is not for the discharge of your legally recoverable debt. The issuance of the cheque is for illegal contract, not recoverable and enforceable under the law. As such you have a consultation with an advocate, who can guide you properly. Indian Law does not recognize and permit to enforce illegal contract. Good Lack.

It is relevant to know if you have given only a cheque to him or signed any other documents also. Another factor is if he files a 138 case are you prepared to face it in court? Is the amount he demanding is unreasonable ? I can help after knowing answers to these.
