False Dowry Case filed by the wife

My brother was mentally tortured by his wife for two years and He couldn't bear any more and filed a divorce and sent a notice to her. Now my sister-in-law filed a false dowry case and FIR was registered against my brother, my parents, my uncle's family and me, even though we didn't asked for single penny as dowry. Also, she sent a FIR copy to my brother's company and now he lost his job. We took a Anticipatory bail and waiting for court hearings. 1) Can my brother go back to foreign country ever for work (some other job) during this case (dowry and divorce case) 2) Why myself, my parents and my uncle's family has to suffer since we are innocent and we didn't asked for any dowry. I am working in IT company so will this FIR affect in any way my career. (if I switch jobs or try for foreign country) 3)Can we relieve at least my parents and my uncles' family from this false case.? 4)How long will it take to win this dowry case?

They may file 498a and other criminal cases, so you can consult and take advice for protecting yourself by the police and law. Recent supreme court verdict is similar to your case. Consult and get advice.

Yes your brother can apply for jobs in India as well as Abroad. If your brother was stripped of job just for a FIR against him you can as well file a case against the Company for serious Human Rights Violation.You have to comply by the bail conditions and choose your job wisely

Hi, You need to hurry in quashing the FIR in court. Because you may be arrested, if anticipatory bail is cancelled. No company would sack the employee based on the FIR. If they had done so, you would have approached court. What is the progress of charge sheet? . You may approach your lawyer for legal opinion of your case.

Let me know whether you and your uncle family and your parents and your brother family are living together under same roof, If is it so, do she have any substantial proof to prove her case before court. Mere allegation will not prove you people guilty so don't worry. Meantime as people like your sis-in-law are misusing the dowry harassment provision under law, now there is a strict instruction to the police that they have to investigate the matter before they arrest the parties who were alleged that they were involved in an offense, hence all of the sudden just on the basis of complaint they can't arrest neither you are guilty until it is proved before the court of law with substantial proofs, so wait for the verdict let your advocate proceed it before the court behalf of you people. Your brother's company has done a blunder by terminating him from the job based upon the FIR copy and the same can be questioned before the court by filing suit against the company by issuing a legal notice to them first. If your brother or you wanted to go abroad for job means you have to seek the permission from the court by showing the proper cause and once again it depends upon your advocate how he proceeds your case before court, it may take one year or even 6 months also. Keep in touch with your advocate and do prompt follow up and attendance before court on every hearing date by providing required information to your advocate. All the best.

That's the misuse of this laws that going on for decades but nothing is being done by any governmental or any judiciary as well , yes for your other query yes you can get relief and most probably your parents as well..you can come and meet me at earliest with the FIR copy and chargesheet copy if possible at earliest .OFC : Adv pankaj Kumar & associate..
