False criminal case on me by some one and i was not in India that so i

Someone filed section 307 on me in March 2023 and he mention the incident of dated 30 june 2022 but i was not their or I was out of india at that time from 24 may 2022 to 17 jan 2023 so i want to book him in false case for maximum imprisonment

If you have received the summons to appear before the court then you must appear on the date fixed and on that date you must file a strong reply/ WS contesting the matter alleging the following case as false and baseless. file a complaint in the nearest police station of your area informing them of the false complaint filed against you. if police does not take any action approach the court of concerned magistrate for registration of FIR.

You can file a FIR against him for cross FIR as well as you can book him under defamation and you can claim compensation for the same under the Indian penal code. and we can provide you Consultancy on this matter if you are interested.

Do consult a good criminal lawyer and take a legal advise as to how to proceed further. So far as your 307 matter is concerned we would like to know about the current status. You can take a plea of alibi Since you were not there at the time of occurrence of crime.

Firstly, file a quashing petition under section 482 crpc and get the FIR quashed. after the FIR, you have the option to file a suit for damages as well as a suit for malicious prosecution in which you can seek compensation and in an alternative, a criminal complaint can also be filed before the magistrate to penalise them.
