Do I have a right in husbands property after divorce.

Respected sir I am hindu by religion. My query being precise is that in git married in April 2012 and was then abandoned by my husband on Oct 2013. I filed dv on which after 3 yrs I received interim maintenance as my husband took every matter to supreme court to harass me and I too filed rcr that is also running. My query is my husband owns a property of 2500 sq feet of flat that was in his name before marriage and after marriage too but when he decided to abandon me after marriage he changed the flat to his mother name so that I can't claim anything so my qs is whether I can get accommodation in that flat or I can ask for different accommodation.and secondly legally do I have right or share in his property owned by him but later thru conspiracy to throw me out changed to his mother name. Heard abt a new high court judgement in this regard.plz help me.plz.i still want to stay with him but he won't.

yes you can still claim from him as well as I need to have a brief discussion with you moreso need to see your documents to guide you properly in this regard. There are recent judgements for the same.

MY OPINION THAT there are so stages of the case /cases which are now held , but the divorce suit is still pending according to your statement, according to your questions, you have absolute right as a legal wife the 50 % of the property and income of your husband, according to Hindu Marriage & maintenance act ,and you have right to claim for flat, contact with me.

You have no rights over the ancestral property or self acquired property of your husband after divorce. But your child if any may have rights over the property if the same is ancestral or if the biological father dies without making any will.However after divorce, you may get permanent alimony while seeking divorce and maintenance of a fixed sum if you are not earning herself till you re-marry.

According to supreme court latest judgement you cannot ask for accommodation in your in-laws house but you can surely ask for seperate accomodation. You have full right to have share your husband's property until you get divorced. More information is required to answer in details.

Dear Madam,
You can with your husband. Yes, by the new judgment you can claim maintenance which is called permanent alimony. You filed a divorce but you want to live with your husband. Please tell why did you file divorce??
Whatever by the new judgment you can claim legally.
