Defamation in Co-op Housing Society

24-Feb-2025 (In Criminal Law)
In my building there`s a lady who is the secretary and she lives all alone. She keeps defaming to other members in the society about my family saying we have done corruption in the society for Rs.10Lakhs and she`s very rude while talking. Majority of members have asked her the evidence of bank statements and audit report but she refuses to provide them. There`s no truth in her statements. We have given a formal complaint to police but nothing has happened till now. What can be done next?

You can file a private complaint in the court against the lady for defamation and issue a notice directly from the court and get the matter proceeded in the court against her and if she doesnt come then she will be arrested by police

you have have given the formal complaint to police. they must have registered just NC. In order to file defamation case, you need to file case in court of your jurisdiction. Also, you need to see if defamatory words are in written or you need to have some evidence against opponent showing that they have defamed you.

Sir We need to go through the complaint first If it’s sufficing then we need to file another complaint before the DCP and if that fails too then a defamation case However if the complaint sent by you isn’t sufficing as per my opinion then we shall refile a complaint to the police

The secretary's false corruption claims amount to defamation. File a legal notice, criminal complaint (Sec 500 IPC), or civil suit. Approach the Registrar, escalate to police or court, or seek her removal via GBM.

Dear client based on your query, It is suggested that, if any person spreads defaming words against someone and the third person believe on the truthfullness of such things then it came under the category of defamation. If you face such things then you may send a legal notice to that. We can assist you in drafting legal notice and provide you with proper legal guidance. For more details feel free to contact us.
