You have the option to move to the High Court against the order. If the order was passed without giving you an opportunity of being heard or because of any mistake of law or fact you have the option to move to the high court. for more details, you may consult me in that regard.

In such a scenario, the accused has an option to move an application under section 482 crpc before the concerned High court of competent jurisdiction. There are ample judgments that explain the situation as is being faced by the accused in your query, and the answer to this is also provided by the apex court, which I mentioned in the beniginning.

Now you can approach the High Court under section 482 and challenge the order filed under section 311 Cr.P.C. In most of the cases where Magistrate reject 311 application if there is not much delay on the part of the accused generally High Court give opportunity to cross examine the complainant
