Crime branch refuses to file FIR

20-Nov-2023 (In Criminal Law)
Hello, I have a genuine case of Land grabbing/embezzlement by my neighbor using forged boundaries. When I approached the crime branch police with a complaint they are refusing to file a FIR and referred the complaint to the local police station. I want to know what are the legal options available for us to proceed further. Thanks

in such a seven day neighbours encroaches the adjacent land and they won't be taken as an encroachment because that is a civil dispute between the boundaries between the neighbours so on regarding that one if your neighbour and purchase your boundary then you must approach the Civil Court to claim your land the entireland as per your document is he was and to remove the encroachment by the means of civil nature the land and they cannot tell in a civil nature when there is a boundary problem which is pure civil dispute

hello, alocious here, I can well observe your grievance here, it's the duty of the crime branch to register fir against such cases on the failure of which we can file a private complaint before the honorable magistrate and get orders for filing fir and investigate the matter, you can contact me for further clarifications. Thank you

You shall escalate the complaint to higher authorities with the proper proof and evidence. If no action despite the escalation, you can file a petition before the court for direction to register the FIR. Concurrently, file a civil suit for declaration and injunction to assert your ownership and challenge the forged boundaries.
