Compounding of offence when complainant is POLICE

06-Mar-2023 (In Criminal Law)
Hello respected members, I have a case registered against me by POLICE under section 419/420/120b/66D IT act. I want to compound the offences (420, 419 & 120B) . I wanted to ask how compounding works in cases where complainant is POLICE and not any other person. Please help.

The offense is very serious in nature and the sections imposed includes a section 420 which is cognizable and non bailable. Would like to peruse the contents of the FIR to give our considered opinion on the same.

As per section 320 IPC 420 is compoundable by the person who got cheated. If the victim is ready to come to terms through negotiations by accepting any terms acceptable by the victim in the given scenario. The other offences mentioned by you are non-compoundable. The offences you mentioned are serious and hence you cannot claim compounding as of right. I will advise you to approach the High Court for quashing of the FIR if you have been unlawfully made an accused.
