Complainant/Informant changed address

25-Jul-2023 (In Criminal Law)
Hi, I'm an informant/complainant in an FIR I filed against an individual under IPC Section 429 and PCA's 11A roughly 2 years back. One of the witnesses has been issued a summon by a district court in Delhi. I on the other hand no longer live at the address that I had provided in the FIR. I'm in no position to go back to Delhi anytime soon. Should I be worried about anything?

Since you are a complainant your presence is not needed unless and until you are summoned by the court for examination-in-chief and cross examination by the counsel of the opposite party. And nowadays the summons are also issued via mail & even WhatsApp. For more legal assistance I am just a call away.

yes you should be.

there is a high probability that since the other witnesses have been summoned by the court you must also have been summoned by the court for prosecution evidence.

get in touch with the lawyer who can inspect the court file and see whether any summons or bailable warrants or non bailable warrants have been issued against you.

should you have any queries feel free to contact me

You need to inform your IO of the case about your new address. As you said you are not active in the previous address, this can make you drop out of the case. And in that case you will not be allowed to give your stand.

No there is nothing to worry about. The amendment which changes minimal details and not the original nature of the complaint may be allowed. For further detailed discussion through consultation please feel free to contact me at any time.

you should update your new address as soon as possible in the court where the trial is going on on the basis of the FIR lodged by you because you will be called as a witness for examination by the court in that case for further proceeding .
