chargesheet vs preliminary chargesheet

21-May-2023 (In Criminal Law)
Can police file preliminary charge sheet and do further investigations to keep the accused in remand for more than 90 days? In my case police has completed all investigations except pending forensic reports and one of the accused still absconding. Can the charge sheet be amended or police can only add further investigation outcomes into the charge sheet?

same court in Bandi Kotayya v. State and Ors. . In the first mentioned case a learned single judge of that court held that the so-called preliminary charge-sheet, filed in the case was not a police report because investigation had not been completed. In the second mentioned case also it was observed that a preliminary charge-sheet cannot be regarded as a report under Section 173 of the Code. The learned judges of this Court distinguished these decisions. Go for bail.. asap.
