Case for criminal intimidating
05-Jan-2025 (In Criminal Law)
I am being charged for criminal intimidating someone on the phone, is it a bailable offence, police is bent upon arrest
In India, criminal intimidation is addressed under Section 506 of the Indian Penal Code (IPC). Here's what you need to know:
1. Bailable or Non-Bailable:
If the charge involves a simple case of criminal intimidation (not involving threats of death or grievous injury), it is generally a bailable offence.
However, if the intimidation involves threats to cause death or grievous hurt (aggravated form), it becomes a non-bailable offence.
2. Police Action and Arrest:
The police are typically proactive in such cases, especially if the complainant provides substantial evidence or claims repeated intimidation.
You can avoid arrest by seeking anticipatory bail under Section 438 of the Criminal Procedure Code (CrPC) from the Sessions Court or High Court.
3. Legal Recourse:
Immediately consult a criminal lawyer to file for anticipatory bail. This will prevent your arrest and allow you to respond to the charges appropriately.
If the charges are exaggerated or false, your lawyer can also advise filing a counter-case for malicious prosecution or defamation.
4. Defending Against the Charges:
Gather evidence to prove your innocence, such as call recordings, messages, or witnesses.
If the charges lack substance or are based on misunderstandings, you can request mediation through the court to settle the matter amicably.
