Can We File Criminal Complaint Privately?

19-Aug-2023 (In Criminal Law)
Some rowdy type people who are having political as well as criminal backgrounds, have beaten me, and now threatening me if I go to ps, nothing will happen n they will file 4-5 false firs or cases against me. And they also threanend me saying even if I go to SP nothing will happen. I know them, they have such background, if someone for complain against them, police calls them and ask "fla fla banda apke against complain likhwane aya hai, kya karna hai iska". Someone told me for private complain application to magistrate, but I don't know process. Also he told me that, to private complain, we will have to go for complain in PS or SP office or both. Is it true?

You have to file a written complaint with the police station detailing the chronological events leading to the commission of an offence. You will also have to provide whatever evidences you have to substantiate your allegations. If police doesn't take action the you may approach SP.

Well, you can skip approaching PS, SP before approaching Magistrate to file Private Criminal Complaint. However, you have to justify your reasons for that. And, I think, you have justifiable reason here to not approach Police, but, you need to prove such reason too, that, Police has no remained co-operative with you, while lodging complaints.
