Can we arrest an Inspector who kept me in illegal custody .

Inspector filed a false FIR and remanded.Can we arrest him through court by filing a private case.

It is important to prove that the inspector of police filed the FIR falsely as against you It is equally important to prove that you are not a part of the FIR , claiming your own reasons Further then it is good for you to file a case against the concerned police official

Dear Client, A.Surendar advocate here, No private complaint cannot be made, on this false FIR case, though you should get a Anticipatory bail first, then can initiate quash proceeding on the false FIR, further more to his senior officer as a Complaint, please contact me for any procedural assistance on the above. yes if you filed a private case against a person, he is not appear on summons then the coury will issue bailable warrant. Thereafter again he do not appear then non-bailable warrant and arrest can be made against. him.
