Questions Answered by Advocate P Ravishankar (50+ answers)

Q: Parents sold accenstral property without my signature

Hi, nMy parents sold our old ancestral property without my signature. Is there any option to revet it back?nBest Regards

Advocate P Ravishankar answered
I can help you with the case. Your parents don't have the legal rights to sell the ancestral property without your consent. You have a share in the sale proceeds of the property. So you have to file a suit for recovery of money of your share in the property in the City civil court at Chennai.

Q: How to prevent future registration

My father bought most properties in his name and in my mother name. After the demise of my father property transfered automatically to legal heirs(myself, mother and sister). Some properties were bought with my money partially means half i paid and half parents paid. Now my sister is living with my mother and it seems like she is insisting to inherit the remaining property in her name. Is there anyway to stop such registration.

Advocate P Ravishankar answered
I can help you with the case. Your sister cannot inherit the property belonging to you and your mother. After your mother's life time, all the properties will automatically be divided into 2 shares, one half to you and other half to your sister. As long as your mother is alive, your sister cannot insist on the property. You have to file a suit for injunction against your sister from unlawfully claiming the property.

Q: Suspension of Father in law based on the FIR filed under 498A

I have been suspended based on an FIR u/s 498A. Is it legal? Can I appeal against it? If yes, appeal with my organization or court of law?

Advocate P Ravishankar answered
I can help you with the case. You can file a petition under section 482 of the criminal procedure code to quash the FIR registered against you by the police. As far as suspension is concerned, your organisation can suspend you if you were arrested and you were in jail for more than 48 hours

Q: Fir filled at 2016. Next what we do.what is mean by fir quashing

But that fir still under investigation.what can i do

Advocate P Ravishankar answered
I can help you with the case. Since the FIR was filed in the year 2016 and investigation is still not completed for nearly 7 years, you can file a petition under section 482 of the criminal procedure code to quash the FIR before the Madras High court.

Q: Registration clarification in new building registration

My builder has 55% PA from agent who has requested to build 22 flats in 3.8 grounds. Flat is fully constructed state. Agent has 45% Share and she will do UDS sign only but builder will do construction agreement alone and i need to pay cost to builder. Can I go for full purchase sale from agent or only UDS registration with agent? Please guide

Advocate P Ravishankar answered
I can help you with the case. The understanding between the builder and the agent does not bind you. It is their personal agreement wherein you were not part of their agreement. It's the responsibility of the builder to give you the completed apartment in occupiable condition, free from any statutory and legal impediments.
