08-Feb-2023 (In Criminal Law)
I am presently a major and would like to file a POCSO case on my abuser who had abused me when I was a minor. The abuser had abused and harassed me along with my mother and sibling. So inorder to file a POCSO case, having few queries as below -nn1. Can the POCSO case be filed through an advocate or legal representative if giving the power of attorney to them?nn2. Can we file this case by my mother or by my sibling who also faced the same abuse. nn3. Should we file a single case on the abuser or file individual complaints.

Hello, 1. You need to file first POCSO FIR with police station where the offence is committed 2. If police didn’t take your FIR then through Advocate your have to file petition for getting FIR registered 3. You both can be complainant against abuser or accused

Well, you guys should file Individual Case or Club your Complaints together as part of the One Police Complaint. However, all three of you have to remain present before the Police Station to lodge a Police Complaint and get it turned into a FIR. Once the FIR will be lodged, Police will investigate and the case will run by the Public Prosecutor before the concerned Magistrate.
