Dear,

You can go abroad for studies but for this, you have to inform the police about your plan of leaving India and the police after recording your statements, may allow you to leave India. However, once the police completes its investigation and files charge sheet in the court, you may need to file a petition in the court for exempting you from personal appearance till the trial starts. For this, you may come India, appear in the court and file the petition or your counsel may file the petition on your behalf.

The fact that an FIR was registered in the name the accused does not entail a restriction on their freedom to travel abroad. This right is not absolute or unrestricted. It is subject to reasonable limitations, which can be determined by the court, and may also be curtailed through any legal procedure. 29-Dec-2022

Yup. Only if youre the one accused. A petitioner (complainant) is not barred from applying for a visa or passport. You must obtain exemptions from the court that has jurisdiction (the court where the case is currently pending) if you are the accused in a case.

A FIR is an important document, as it starts the criminal justice process. Only after the FIR has been registered at the police station will the police begin investigating the case. Can we go abroad if we have a case?

If you are facing a criminal case, you can travel abroad. If the Court has imposed any restrictions on you, such as preventing you from leaving the nation or requiring you to obtain permission from the Court before you travel abroad, then you should not/cannot travel abroad.

The police cannot allow you to travel overseas while a criminal or FIR is pending against you. You might have to go to the court by yourself to ask for permission to travel abroad while the FIR is pending against you.
