Can i do a counter case if there is a fake 376 against me

Hello AdvocatesThere is a fake 376 and 377 filed against me in Delhi Rohini area by my girlfriend who is a professor in a renowned university here. we were in a consensual relationship and later i broke up, though we discussed marriage in our relationship but not at the start of it. nShe filed a FIR against me in revenge and entered many false things in FIR which i can prove wrong. I have got the anticipatory bail in sessions court but now i want to put FIR against her. Kindly help. Also she is 3 years elder to me and a very famous professor.

Dear client I advise you first go for a quashing. In case that comes in your favour. You may explore the possibilities of a defamation case. Unless and until there was any criminal intimidation etc an FIR won’t be advisable as it would come across as a counter blast action. Feel free to get in touch to discuss further

if there is a FIR against your name then there has to be a proceeding before the court. Since I can understand your position as an advocate, but i will suggest you to defend the fake FIR in the court rather than filing a new case. Since you got anticipatory bail then it is better to defend your application rather than going for a fresh FIR

1. If false case has been filed wherein false and fabricated evidence has been given, an application under section 340 crpc can be filed. 2. giving and fabricating false evidence is a crime and courts are taking a strict view of the same. 3. incase of any further queries feel free to contact me

You have various legal remedies, both civil and criminal, but for that the first step would be to either get an acquittal in the FIR-case or get it quashed altogether from the High Court of Delhi. Once you are free from the case with a verdict of Not Guilty, you can file other cases against the said woman for implicating you in a false case.

You can give your complaint to the concerned police station for the same, however police generally don’t register cross FIR I’m such cases …therefore you need to hire expert advocate to file complaint case if you have conclusive evidences !l B in touch
