Can Guy loose the case only on girls statement 376 fake case

As per FIR the girl says that promise to marry happenend on 12th of January 2022, but the boy has proof that she was in same room with him having consensual sex before that also. Will it attract 376 IPC. In India just girl giving a statement without proof works??nnWill the guy loose the case even if he has proof he being in same room with her where the girl is a MD doctor, highly educated travelling distances to meet the guynnCase filed after 8 months

IF THE CASE/FIR IS FILED AFTER 8 MONTHS OF THE LAST SEXUAL INTERCOURSE AND THE GIRL IS MAJOR AND CAN UNDERSTAND THE CONSEQUENCES OF THE ACT SHE IS DOING AND DO NOT HAVE ANY REASONABLE GROUND FOR THE DELAY IN FIR THEN THERE ARE CHANCES THAT BOY CAN WIN THE CASE. BUT ON THE STATEMENT OF THE GIRL HE CAN TRIED UNDER SECTION 376 FOR RAPE BUT CAN BE ACQUITTED LATER WHEN IT IS PROVED THAT THE CASE IS INFRUCTUOUS.
