No, it depends on case to case. Mostly in criminal cases only a person who is Alleged Accused in the case is liable to attend court and not his family members. So if the Accused has passed away and case is pending in the concerned court, The death certificate of the accused is mandatory to submit before the court to verify the death. Or you can ask your Lawyer to appear in concerned court and give submissions to verify the death by court officials. And then the file get closed.
