Can a lawyer be changed in middle of quash proceedings in high court

08-May-2024 (In Criminal Law)
Dear Sir, I have been wrongly framed in charges 498a, 313ipc but the lawyer who filed quash petition in high court got colluded with opposite party and try to drag case by telling us that quash proceedings takes time to come for hearings in high court even after lapse of one year. Can I change my advocate at this point of time or whether my advocate will create problem. Plz guide me

Well, if you have lost trust on your lawyer, then you can change him. However, you need to take NOC from this lawyer by clearing his Professional fees before discontinuing with him, otherwise, he will not issue you NOC. Now, you can ask me, as he collided with the opposite party, you do not want to pay the balance professional fees, if any, to this Advocate. However, one thing you are forgetting, that, you need to prove the charges against that Advocate that he collided with other party, if you do not want to pay him his balance dues or fees before discontinuing with him.

You can change your advocate at any time of the proceeding. You have to obtain a signature (as an NOC) from old advocate on the vakalatnama of the new advocate. Every advocate generally grants NOC to their clients, provided his legal fees are paid till date.
