Hi, After me sending divorce notice , wife has filed an FIR with these sections BNS 85, 352, Dowry provision action 3,5 including my parents which is false. In police station itself we exchanged our jewellers with notify signed. My wife also working , during marriage period she transferred her salary to me voluntarily,now she filed false case against me and family. Chargesheet has been filed, other than banks salary transfer no evidence attached and her family witnesses.What will happen?Pls help

sir, exchange of jewellers in police station etc was not proper, you should have insisted for mutual consent divorce and in that you could have got everything settled, however now the best thing you can do is approch the high court and file writ petition to quash the chargesheet filed against you and your family and take a stay order on the further proceedings on case filed against you and your family, further you and your family members may receive a summons to appear in court, you have to appear and seek a bail, if chargesheet is not quashed you have to face the trial, whether the court will decide whether you and your family members are innocent or not. further proceed with a divorce case.

Sections 85 and 352 of the Bharatiya Nyaya Sanhita (BNS) refer to cruelty by a husband or his relatives and intentional insult to provoke breach of peace, respectively. you have to take bail immediately.

Sir, As per your issues , you can file a quashing petition before the High court of Karnataka but possibilities are the chargesheet may be quashed against your parents but you have to be faced trail before the trail court. filing quashing petition and other legal assistance feel free to contact me. Dear Sir, ​Discharge Application Since the investigation lacks independent evidence other than the bank statements an application for discharge can be filed before the trial court arguing that the allegations are groundless and do not disclose a prima facie case to frame charges

hello as you told it is common now days. if you send fact of the false case in detailed will try to quash the FIR in high court. but needed more information related to the case. feel free call or send the messege about your facts
