Hi law expert's, my question is, my wife is asking monthly 24000rs rent for the house which she only made, after coming out of the matrimonial home without reason,and we both lived together in that house and she filed DV case against me in DV section 19(f) she is claiming residential rights for 24000 monthly, my question is without Trail , may court grant interim residential right order to her?how can I prove to court that she only left the house without informing us, how can I prove my innocence in this matter?I have video of my wife moving out of my home, when can I produce to court? Q: Filled Criminal Case Family Property
Husband purchased a property in wife name in the year 1990 from his own sources of income.And property was registered in the name of wife itself.Later at 2004 wife expired. And husband got the property transfered to his name by producing death certificate of wife. And got khata transferreed to his name.And further father executed gift deed in the name of childrens. Except one child. Now that one child has filled criminal case . In the form of PCR and filled sections 420 , 471, 120b and other sections . He has some doctor records saying father was not well. And he has filled this case after 10 yrs of execution of gift deed now even father has got expired. He is saying that father was not well and they have forged fathers signature. But it was executed by father itself and has his thumb impression , Signature and even photo on gift deed executed in subregister office. Will now there will be any problem for other childrens who has got gift deed executed???
