Bail taken from court but lawyer not providing case no

Sir, there was several bank transactions to the tune of between May 2010 and Aug 2011 We returned 1.5 lack through bank and rest in cash. In September 2016 he filed an FIR under Crpc 156 (3).We got AB from sessions court and got regular bail from court. Thereafter there is no communication either from court or police station. Due to safety reasons we could not go and inquire in person. Every now and then advocate is asking money he says police filed charge sheet but not providing a copy or case no. . I enquired through on line ecour. got. In site there is no case even when I check daily board of the court on which the adv says the case date it doesn't show my name. Please help me

HI,

In this case, you can check case by your case number at that court. If you are not satisfied with that lawyer you are at liberty to change him.

Also, in this case, if you have a claim that you have already paid the amount, you can move to the High Court to quash the further case proceedings.

Dear,

Approach the Advocate whom you are entrusted the case and ask him to provide case no.If he is not willing to do so, you can very well relinquish Vakalath and you can engage another Lawyer.

As you have taken bail means there will be an existing case. If you remember the date and court which you have taken the bail then we can do something. Or else you can approach the concerned police station to get the further details

You have not specified as to the amount of loan/money taken by you and for the purpose taken. Though you have mentioned that you repaid an amount of 1.5 Lakhs and rest through cash, you have not specified whether you got an acknowledgement for the same. If you have not obtained an acknowledgment it is as good as non payment of rest amount . Hence, please be specific on that aspect.

Have you gone through the FIR and are you aware of the charges framed against you since you have mentioned that you got a Bail.
You need not go in person your representative may be send. Be strict on asking your advocate the case number and try obtaining a copy of charge sheet. Specify to your advocate until and unless he/she provides you with the details you are not going to make any further payments. Keeping the client in dark in regard to the clients case is against professional ethics and amounts to professional misconduct.
