Can a person with a pending court case under sections 341 and 343 leave the country, even after receiving the first summons two weeks ago? Please advise.

Hi,Normally when a criminal case is pending before the court, the accused person need to apply and take permission of the court concerned, to go abroad. Q: How to get rid of online loan harassment in India?

I have taken money from a person 1 yr back on an interest rate of 3%. However due to some reason, I was unable to pay it. Now I have asked for a last 3 months period which I agreed under his pressure. He is asking to put an agreement with this 3 months period. I have got a call from Police SI as well asking to do so. I need 1 yrs time to pay the amount and interest back to the person. Moreover the person is giving me tremendous mental torture as well. Kindly advise as on what can be done.

Hi,In this case, that person who gave you loan or the police cannot torture mentally you or force you to enter to such an agreement. You advised to file a police protection and police harassment case in the Hon'ble High Court, so that he or the said police office will stop intimidating you in this account. Q: Procedure to get property divided when one person is abroad

My father had 3/4 acre land with value of 5 crore in kerala. He has 3 sons ( including me), one daughter and my mother. Other than one son, all are wanted to get partition this property, but one son ( eldest one), he is staying in abroad doesn't wanted to get partition now. All property belongs to the name of my father, he expired 15 years back. What is the solution to get resolved legally without the presence of one son? Please advise

Hi,In this Case, every individual has the right to get the undivided property get partitioned in their name if they have a right in that property. If other parties willing, all parties can execute a partition deed and get it registered. If any of the persons are not willing to get it partitioned, in order to effect the partition of the property, you can file a Civil case for partition of the property in the Munsiff court or Sub Court, as per the appropriate jurisdiction.
