bail can be filed only after police custody is over and accused is remanded to judicial custody. Depending upon the offence in which the accused is arrested bail will be filed either before magistrate or before the sessions Court.

Well as soon as you get arrested Police has to mark your appearance in the nearby Magistrate Court within 24 Hours Your lawyer should apply for Regular Bail in the Magistrate Court while you marking your attendance over there.
