Bail grant to the accused of 498A

08-Aug-2023 (In Criminal Law)
Dear Sir/Madam My sister filled a case against her in-laws under 498a and dowry act etc. Today all accused get anticipatory bail whereas he got second marriage and we had submitted the proof of marriage (Register copy of registered temple where he did marriage again). The accused had submitted the affidavit that he did not marriage again and lower court had granted bail to all the accused on the ground of affidavit without conforming from the any trust-able source. Now what action should have to take so that accused can punished. It is 100% true that he submitted the wrong affidavit to the court. The divorce given by him is running in other court and not settled till date. Please suggest me what can we do?

This has perused from your saying which means, he has committed groce misconduct in the eyes of law, if he has placed wrong facts before court., His bail may be cancelled by filing petition to the same court . You should decide to do so. He may be in big trouble.

If bail has been obtained by submitting wrong affidavit, then it is wrong under eyes of law. Contact a good lawyer, apprise him about all facts, documents and ask him to file an application for cancellation of bail.
