Applicability of new supreme court guidelines on 498A on old cases

Dear Expert, My wife had filed false dowry demand complaint at SSP Office on 11 April, 2017. The case had been given to DSP for investigation. The DSP is yet to submit his report. I wish to know whether the new guidelines given by Honorable Supreme Court on 498A of referring case to Family Welfare Committee is applicable on my case as well.

Hi yes you must get your lawyer in dsp office and give reference Of hounrable supreme Court.if officer will not agree than you submit your appeal in court and demand that your case refer to welfare committee.if need help contact me

Only those cases in which is pending would be sent to welfare committe subject to the fact that committe is set up. In your case if the report is not submitted and committee is set up then surely it can be sent to the same.

Yes, your case is pretty much applicable but I doubt that there will be a family committee so early. But it is better to try your luck with the authorities. The job of DSP office and committee will still remain the same, handle the issue amicably. This will lead to a court case and if there is some criminality involved in your actions, then you be beware. Best is to give what she wants and buy time with money or else she will easily eat 2-3 years in these proceedings. And what more your chances of marrying someone young again. So think and choose carefully which way you want to go.
