Q: TS1 form & Non encumbrance Certificate for residential property

Dear Sir/Madam, I am purchasing a residential property (Built Resale House) in Patiala City without KHASRA No. Property was sold in 1986, 1994 & 2015. In 1986 by Mr Mahinder SIngh to Taran Kaur. In 1994, by Taran Kaur to Iqbal Singh and in 2015 by Iqbal Singh to Manjit Singh. I have applied for a Bank LOAN. As per the requirement of Bank i need to submit TS1 form. I got it from MUNICIPAL CORPORATION but TS1 form has been issued with the name Mr Mahinder SIngh (1st Owner) becz as per reord in Municipal Corporation, Mahinder Singh name is appearing. But Bank is not accepting it. Kindly advise. what is ts1 property ?, Also advise can we obtain a Non encumbrance certificate from registrar for Non Khasra property (Without khasra no) as it is also another requirement of bank.

Hi my dear friend first of all you need to change name on munciple record on second owner mohinder Singh to taran kaur and from taran kaur to iqbal Singh and from iqbal Singh to manjit Singh. It's long process.you just fill the copy of transfer deed.no objection certificate from the associated housing socity and matation of property.fill the request in the office of muncilple office.these documents help you to change property on your name.without these changes munciple will not issue ts 1 on your name.i think there is many person which help you in this work.i came to know one of my friend get these change in his property record.other wise you file the case in the court for legal remedies.secondly you ask for loan.here punjab govt under minsters of tota singh start work to make record of red line property.on many places this work is completed.Delhi people also face these similar problem. In delhi many private bank make policy to give loan under red line area property.where people have no Farad.you also contact these private bank.

Q: Where to apply for withdrawal of surety bonds, is it possible to do so ?

appellate high court suspended the sentence of accused during pendency of appeal on giving surety on satisfaction of CJM, now a person give surety of accused in chief judicial magistrate's court on direction of high court wants to withdraw his surety bonds, now from which court he can withdraw his surety, aapeal is pending in high court. surety wants to withdraw his surety bonds in which court he can move application for withdrawal of surety ? high court or cjm court?

Respected, you can apply to withdraw the surety bond under the section 444 crpc in trial Court.simply you make affidavit to withdraw the surety bond.you must filled this affidavit with the help of your lawyer.

Q: The builder has done two registries of the same flat

I have bought a flat and it was financed by an Indian institution. I am paying the EMI. Now I got a notice from another bank, stating that it was financed by another bank. I came to know that the the builder has done 2 registries of the flat. With different khasra number. What should I do? Please guide.

Hi first of all you write letter to builder about this and send registed post.than you write about this to bank and give them knowledge all matter.if builder will not solve your problem than file complaint against builder in police station.you also file a case in court and get relief.

Q: Sale of ancestral property without consent of other claimants

My grandfather had some property. He had 3 sons of which my father was the eldest, the youngest one sold all the property without the consent of any of the 2 brothers. The middle one got his share. Rest of the money was used to purchase property in a different state. Now the middle one of three siblings, my father is no more, and I am planning to sue my uncle for my share, I am 23 years old now. What should I do?

Hi.first of all is your grandfather is live during the sell of that property.is your grandfather made any will.if your uncle sold property after the death of your grandfather and there is not any will.than you defiantly demand your father share from your uncle.please collect all documents which show link with the purchased property.

in july 2013 i had taken a loan for pigry farm in subsiby under nabrad bank How to get detailed back date rate of interset to put onmy loan amount by govt to a agriculturist i think they are charging me very high rate of interst.?

Hi first of all you collect detail about rate of intrest from RBI website if bank impose wrong intrest on you than you collect all document and contact bank customers care officer and complaints against this.if bank officer will not give you relife than you approach the banking ombudsman. This is senior official appointed by reserve bank of india.mostely this officer sit in state capital.you find his address on reserve bank of india website.you get all documents with you when going to met this officer.mostely this officer give his verdict in one month after complaint
