Advise regarding 304a case disposal by the court.Need advise regarding

SirnMy husband is involved in a case of 304a. He was the project head in a private construction company when a worker died accidentally in 2015.Now they are coming with warrant .kindly advise me what is the way out of it.The worker was compensated by group insurance and by company.

Compensation is different and punishment is different. Your husband is not alone liable the entire management should be liable. Your husband is just employee. He need to face the criminal case and take such defence..

when warrant is issued against a person if he not appear on summons. If it is your case you engage a counsel and recall the warrant by application under section 70(2)off cr.p.c. and convey the court if the matter is settled by way of proof of relevant documents.

I can help you with the case. First of all we need to file a quash petition in the Madras High court under section 482 of the criminal procedure code against the case registered against your husband by the police. Since the death of the worker is only accidental and the worker was already compensated, we have a very good chance to succeed in the Madras High court
