25-Jun-2025 (In Criminal Law)
i am the defacto complainant, my petition was disposed in high court, then what should i do sir, accused filed a quash petition, quash petition aloowed by high court. i have 164 statement of railway judge, but my advocate collued with accused, then what should i do sir.
Based on your situation you are the de - facto complainant. Now you have the chance to file a Review Petition in the same High Court .The Review Petition must be filed within a short period . If you believe that the High Court wrongly quashed the case, you have the right to file special petition under article 136 of the constitution . Immediately Consult lawyer to review your case .
If the High Court has allowed the quash petition and you believe your advocate colluded with the accused, you may consider filing a review petition or Special Leave Petition (SLP) before the Supreme Court, especially if there is strong evidence like a 164 CrPC statement supporting your case. You can also lodge a complaint against your advocate with the Bar Council for misconduct. I can guide you with drafting and filing the next legal step — feel free to reach out for detailed support.
