02-May-2023 (In Criminal Law)
Respected Sir, Long time fighting going between me and wife. Recently she filed a FIR against me under 66c showing up some evidence of her email / Facebook being hacked by me thru a friend etc. Police found no direct evidence against me other than some call record between me and my friend. My friend was made Witness against me. Now the Friend is decaeased. My question is Can I request to dismiss the case? Any other suggestion?

If the FIR was lodged against you and subsequently the police have filed charge sheet against you before the magistrate then yiu have couple of remedies either to get discharge from magistrate or to challenge the FIR and charge sheet before the high court

Well, if Police has found no evidence against you, then on producing the Chargesheet in Court, the Court will look into it and as such, if this Chargesheet won't be objected by opposite side's Advocate, then, automatically the case against you will get dismissed.
