420/406 need to close case in favour of respondent

17-Mar-2023 (In Criminal Law)
FIR filed under 420/406 and after mutual discussion complete amount in FIR was returned back to petitioner via rtgs. FR has been filed by police stating same and is in civil court with status For notice/summon. What will happen next if respondent is not in position for appearance in court ? How to bring this case to closure without appearing in court as a respondent ?

Hello as per your query I would suggest you to file for a petition in high court that the matters are over between the parties as payment made . For further information on this contact me with the registered mobile no with lawrato.

if the summon is duely served on the complainant and compainint not turn up to court, court may accept the final report submitted by investigation officer in absence of compainint and close the case then respondent need not to appear before court.

Hello client, if police has filed final report in case of 406/420 IPC and not filed any chargesheet against any person then in that case the court will issue notice for appearance to the complainant for confirmation that he has received all the amounts and all the dispute resolved or not. So in my view the appearance of accused person/ respondents are not required. I hope that you will get all the necessary information. if you need any further information or clarification then please call me back through the administrator of this website
