Advocates, my question is about 164 statement and 161 . In 161 she says that even before meeting she had intimate conversation and the day she met she booked the hotel room and came inside my room now in 164 all this is not mentioned. 164 doesn’t contain any events that are not their in 161. Relationship lasted for 2 years. What can we understand from it

जब किसी लड़की अथवा औरत के साथ कोई लैंगिक अपराध कारित होता है या वह किसी के खिलाफ आने में प्राथमिकी दर्ज कराती है। अपराध की विवेचना करती है तथा जांच अधिकारी पीड़िता का बयान दंड प्रक्रिया संहिता की धारा 161 के अंतर्गत दर्ज करती है । पीड़िता का मेडिकल कराने के बाद अन्वेषण अधिकारी उसको मजिस्ट्रेट के समक्ष दंड प्रक्रिया संहिता की धारा 164 के अंतर्गत बयान दर्ज करने के लिए प्रस्तुत करती है। पीड़िता का बयान एकांत कमरे में स्वयं दर्ज करती है तथा उस बयान को एक लिफाफे में सील बंद कर बात पत्रावली के साथ सुरक्षित रख लेती है। दंड प्रक्रिया संहिता की धारा 161 में दिए गए बयान को न्यायालय साक्ष्य के रूप में स्वीकार नहीं करता है जबकि धारा 164 के अंतर्गत दिया गया बयान साक्ष्य के तौर पर है। अर्थात उसने पुलिस में जो भी कहा वह सही नहीं माना जाएगा जब तक की उसके कथन को किसी अन्य साक्ष्य के द्वारा साबित ना करा दिया गया हो ।
