How many years of conviction will be given if 304 II is proved?
hi.
if the offence of 304 II IPC is proved, the punishment is upto 10 years.
however to prove 304II mens rea should be established beyond doubt. i.e the accused had knowledge that his action will cause death, but had no intention to cause death.
