15-May-2024 (In Criminal Law)
There is an ongoing case on my Parents and elder brother on 304-B,498-A,506,504, My brother's wife died at her parental house not in our house she was there from the last 4 months of her death. The case is on the hearing stage, My name was included in the FIR but police removed my name from the chargesheet. All 3 are on bail, I need to know if the other party can include my name again on using 319, what will be the remedies?, do I need to file bail? Can I be arrested? Precaution I should take.

If you have certain evidentiary proof that you might be attested then you can file for anticipatory bail. If you are summoned after 319 Crpc then you have file for a regular bail under 437 crpc. you might be arrested if the chare are serious in nature

No... you have to file the anticipatory bail in court in the following sections after filing of the charge sheet and yes you will not be arrested because your name was already removed by the investigating officer. If the other party is trying to include your name you have to contest in the court and your lawyer will argue.

at present there does not seem to be any need to move for bail. if the other side takes any steps for inclusion of your name in the chargesheet, you will get an opportunity to respond. when you see that coercive steps are imperative, only the move for anticipatory bail.
