10-Jul-2023 (In Corporate Law)
Hi my company has signed a mutual agreement between many companies saying that not to recruit any of the employees from their company and vice versa. Kindly help me on how to proceed further as my parents are ill but they are refusing to move to the companies that they have an agreement.

In a situation like this for your convenience you should look for job in such companies wherein your present organization do not have any agreement barring them to recruit you.
If that do not seems feasible to you then I will recommend you to sit along with the HR to have the list of such companies wherein you can't be hired as per the agreement so that you can avoid such companies and the efforts thereto.
Further you can discuss your case in person and can seek exemption from this agreement agreeing to any special circumstances which willallow you to move to other organizations. Mind you don't agree to any absurd agreement and it's clause on the pretext of special agreement.

Your query is unclear. However, it seems that your parents have entered into some kind of non-compete agreement. In that case, joining such companies would amount to breach of contract. Having said that, please thoroughly go through the agreement as there might be a period during which such employment may not be taken up. After the expiry of such period there should be no bar.

The query is not very clear. However, prima facie the contracts sounds like it is flawed and anti-competitive. It may also be in breach of the Indian contract Act. As such, the enforce-ability of the same is doubtful. Do share the details for further discussion.
