Selling, dealing, manufacturing, or keeping on display for sale and packaging, trade dress or product infringing the Trade mark of any Proprietor is an offence and you can be sued by the proprietor of the registered TM. Any reproduction or second copy sale is legal only with due permission of the TM Proprietor.

(assuming you are in India and asking from a Indian legal standpoint)
There is no legal way to sell a first copy.
Any kind of copy being sold either online or offline is not legal.
Mostly, design of the product, logo, bran name, etc. are trademark protected.
In case you are talking about selling defective products, it has different rules & regulations.

Selling first copy products, including first copy shoes, is not legal in India. First copy products are essentially counterfeits or replicas of branded items, and their sale constitutes a violation of intellectual property rights. Here are some key points regarding the legality of selling first copy products in India:
  1. Intellectual Property Rights: First copy products infringe upon the intellectual property rights of the original brand. This includes trademarks, copyrights, and patents. It is illegal to reproduce, distribute, or sell such products without the brand owner's permission.
  2. Counterfeiting: Selling first copy products is considered counterfeiting, which is a criminal offense in India. It involves selling lookalike products with fake trademarks, logos, or branding.
  3. Legal Consequences: Those involved in the sale of first copy products can face legal consequences, including civil lawsuits and criminal charges. This can result in fines and even imprisonment.
  4. Consumer Risk: Buyers of first copy products are also at risk. These products may not meet safety and quality standards, potentially posing health and safety hazards.
  5. Brand Reputation: The sale of first copy products can harm the reputation and business of genuine brands. Brands invest in research, development, and quality control, and counterfeit products undermine these efforts.
In conclusion, selling first copy products, including first copy shoes, is not legally permissible in India. It is advisable to avoid engaging in such activities to stay compliant with intellectual property laws and avoid legal repercussions.
