Would Their Be Trademark Clash Or Objection Under This Case

11-Mar-2024 (In Trademark & Copyright Law)
Suppose I'm into Henna business & want to trademark the name HennaBox.com & sell my products worldwide. But during Google search I find that Henna is also spelled as Heno in some other country or language & someone has trademarked HenoBox.com & is selling Henna in their country. So in this case would their be a Trademark Clash, Objection or Infringement. If yes, then in terms of percentage, what are my chances of getting trademark registered & winning the legal case against third party ? Thanks

Hello,

The matter at hand is complex and needs to be seen what the Trademark filed by the both the parties is. The chances of your mark being survived and having proceeding for registration are stronger if the other mark is only a device mark and not a word mark. However the level of similarity is also an important factor to be seen. You may please contact us for further consultation. We'd be glad to assist with filing as well as any and all such concerns.
