Wrongfully restricting tenant Co-Operative Housing Society(Mumbai)

10-Apr-2023 (In Consumer Court Law)
I have 1-bhk Flat in a CHS in Mumbai. After government start partial unlock(phase-1) in June 2020, a prospective tenant approached for renting my flat. Managing Committee of C.H.S. objected that some dues are pending against your flat hence you cannot rent out the flat. I paid the CHS whatever amount was undisputed and asked the CHS to give some to verify the accounts as to on what pretext more amounts are pending. The CHS didn't agree, Chairman of CHS insisted that I pay the entire dues first then claim refund later if I want to rent out my flat. Since, I was short of money due lockdown I requested the CHS to give me more time. But they refused. I have executed registered L&L agreement with my tenant & also got police verification done. Yet CHS didn't allow my tenant to take possession despite having all the valid documents. I was forced to return the token amount received from tenant as he failed to take possession even after 2 weeks. Can I claim damages from CHS at Consumer Forum?

You can file a Case against CHS before the Cooperative Society Court & seek compensation in the form of financial Damages which you suistained + you can seek Pecuniary Compensation + Mental Harassment Cost. Hope you got my point.
