Writ petition for directing the consumer forum to pass the judgement
14-Jul-2023 (In Consumer Court Law)
My matter in delhi consumer forum is pending for final argument but since the lawyer of OP is not appearing, the judge adjourns the matter for next date. Till when this would continue , it has already been 7 adjournments. Can I go to high court with a writ petition to direct the Delhi consumer forum to give out judgement based on written arguments ?
Yes the writ can be moved as well as appeal can be moved by moving application for final disposal.
I did exactly same for one of my client where OPs are not appearing Andy client’s earlier counsel was not pressing the arguments. Consumer commission issued notice as last opportunity for final arguments through xparte.
Please feel free to reach out for further assistance

Matter pending for more than 5 yrs are taken care of by the NCDRC with utmost expedite. In case your matter is still pending due to the neglect by the OP, then first you should seek remedy of approaching the Court No. 1(president) of NCDRC for expeditious hearing and lawyer should get a favourable order for the same. If this fails, High Court jurisdiction can not be used. But remedy can be seek from Supreme court
First of all file an application before the forum to hear your ex-parte arguments stating therein that several opportunities have been provided to the OP but still they are deliberately avoiding the forum and praying to announce ex-parte judgment.
If still forum denys it then you can approach state commission against the same.
