Builder/developer agreement need to be checked, terms and conditions, and responsibilities of the builder/developer need to be studied before coming to any conclusion.
If it's poor construction then definitely a case can be filed after getting it photographed and a report from any govt recognised engineer highlighting the defects in the construction and this can be taken in to account.

actually top floor owner is responsible for the if leakage from above flat and he had to make repairs to control leakage. if leakage from open terrace builder is liable to effect repairs. if both failed to take approprite steps to effect repairs approach consumer court.

In apartments this kind of issue come very usual we cannot question the builder on it because he have already deliver all the flats and apartment to its welfare association and we cannot question the flat owner also it should be borne by apartment welfare association only.
