Q: can someone used me as a reference for a loan India

Hi, my colleague applied for a personal loan through HDFC Bank and used me as a reference for a loan in India.

Now, he has missed payments and switched companies. The bank keeps calling me, saying he is not answering their calls. Today, a bank representative threatened that a legal case may be filed, and I might be included in it.

However, I never signed any document as a guarantor—I was simply listed as a reference name in his loan application.

I want to know:
1️⃣ Am I liable if the borrower does not repay the loan?
2️⃣ How do I remove my reference number from the loan account?
3️⃣ Can I take legal action against harassment by the bank?

I contacted my colleague, and he said he would check with the bank. However, I don’t want to be involved in this matter anymore. What should I do if the bank continues to threaten me?

Banks Cannot Harass You for Being a Loan Reference

No financial institution can legally harass you for being a loan reference. Only loan guarantors are legally responsible for repayment. The bank is applying pressure tactics to track down the defaulter. Here’s what you should do:

• Firmly tell them you are not liable and that they should stop contacting you.
• Request a formal notice from the bank instead of phone calls.
• If harassment continues, file a complaint with the Reserve Bank of India (RBI).

It depends on the type of property. If it is ancestral property, the rules are different. If the husband bought it himself, the wife usually cannot claim it. However, if the property was purchased using both the husband's and wife's money, it may be considered joint property. All these factors need to be considered.

I cannot disclose the fees here at it is not permitted.you can approach after taking the NOC from your advocate along with the complete file, all documents etc., from the earlier advocate.without seeing the complete file and studying the case fees cannot be disclosed.

You can register a complaint in the Police station and Police after investigation will file a FIR. Take a copy of all the documents, receipt and your adhaar card copy to the police station. it's a case of cheating and you can ask for the amount along with 9% annual interest on the amount given.

It the appointment on the compassionate grounds. You need to forward your application through the MLA of your constituency and requesting to appoint you in place of your grand father. If you are covered under any reservations like BC, SC & ST etc., please get the required documents and all your educational certificates along with your aadhaar card and ration card.
