Questions Answered by Advocate Sanjay Kumar Patel
Q: Wanto raise a complain on E-daakhil/ consumer court
I am having Tata Tigor and on 23rd July due ot flood, it got damaged internally with water and external with dog and Monkey's run on roof and roof of car got damage. While submitting car, it was told to me to put in flood loss first and later in roof damage. After 2.5 months car serviced and returned. After checking rust is there, ants under seats, a lot of issues unresolved. so, I asked for such pending repairs and roof replacement. Car is with Tata service centre, insurance is of Tata.
Advocate Sanjay Kumar Patel answered
Service-centre responsibilityUnder Sections 2(11) and 2(42) of the Consumer Protection Act, 2019, inadequate or negligent performance of a paid service can constitute “deficiency.” The centre should complete the authorised work with reasonable care and in line with the job card and approved repair scope. Rust, ants, or other unresolved problems may support a complaint if evidence shows they were left unaddressed or arose or worsened while the car was in its custody. Consumer Protection Act, 2019Flood and roof claims are distinctThe insurer’s obligation is governed by your policy, endorsements, exclusions, deductibles, survey findings, and proof of causation. Submit the flood-related water-ingress damage and the animal-related roof damage as separately itemised claims or claim components; ask for a written decision on each, identifying any policy clause relied on for a rejection. Roof replacement is not automatically covered merely because the flood claim was accepted. IRDAI RegulationsDocument the present condition and demand a joint inspectionPhotograph and video the car, including the roof, cabin, rust, ants, odometer, and warning lights. Obtain a defect-wise written status report and request a joint inspection with the service centre and insurer’s surveyor. Preserve the original and supplementary job cards, estimates, survey report, approvals, invoices, delivery note, claim correspondence, and proof of the car’s condition before and after workshop custody.Send a formal written demand and escalateWrite to both the service centre and insurer, reserving your rights and stating that accepting custody does not mean the repairs are satisfactory. Request a rectification plan, completion date, separate written coverage decisions, and copies of the survey and repair approvals. If unresolved, use the insurer’s internal grievance process and then the applicable IRDAI grievance channel; retain acknowledgements and complaint numbers. IRDAI Regulations
Q: Name correction in marriage certificate
In the original marriage certificate issued tomy son it is misplled by Vadodara muncipal Manjalpur so correction to be done pl guide me
Advocate Sanjay Kumar Patel answered
Apply to the issuing office firstSubmit a signed application to the Marriage Registrar, VMC, Manjalpur, quoting the certificate number and registration date. State the incorrect and correct spellings and explain that the request is only to correct a transcription error, not to change identity or marital status. Ask the office to check the original registration application and register entry.Provide supporting documentsEnclose the original certificate (or present it for inspection), copies of both spouses’ identity documents, the marriage-registration receipt/application if available, and reliable records showing the correct spelling—such as a birth or school certificate, passport, or other government record. A joint declaration or affidavit explaining the mistake may also be useful. Ask VMC for its current checklist and obtain an acknowledgment; do not surrender the original without a receipt. The VMC Marriage Registration Portal does not publish a correction form or document checklist.Form, fee, and time limitNo separate correction form, correction fee, or fixed decision period is identified in the available VMC portal information. The portal states that an online appointment requires a non-refundable ₹100 administration fee; this is not stated to be a correction fee. Confirm any correction charge and expected processing time directly with VMC, preferably in writing, before paying. VMC Marriage Registration Portal
Q: Subject: PNB Account Freeze – ₹1.70 Lakh Blocked Due to Arbitration Or
Question: Mera PNB bank account arbitration order ke karan freeze kar diya gaya hai, jismein mere lagbhag ₹1,70,000/- pade hain. Kripya batayein ki is account ko unfreeze/open karwane ke liye mujhe kya legal process follow karna hoga? Kya main Arbitrator ya concerned bank ke saamne objection/application de sakta hoon, aur account unfreeze karwane ke liye kaunse documents aur steps zaroori hain?
Advocate Sanjay Kumar Patel answered
Arbitration and Conciliation Act, 1996—India CodeSection Bhaven Construction v. Arbitration and Conciliation Act, 1996—India Code
Q: Mutual Consent Divorce Application via Special Power Of Attorney
Hi, My name is Karan, currently based internationally and have to file mutual consent divorce application with giving special power of attorney to my father. I've received the draft from wife's lawyer. I want to know how should this be done- Is online notary possible in this case? what is the process. PETITION FOR DISSOLUTION OF MARRIAGE BY MUTUAL CONSENT UNDER SECTION 13(B) OF THE HINDU MARRIAGE ACT, 1955 MEMO OF ADDRESSES (Pursuant to Order VI Rule 14-A of C.P.C.)
Advocate Sanjay Kumar Patel answered
A Special Power of Attorney (SPA) signed abroad must be physically or locally notarized by a notary public in your current country, and then attested by the Indian Embassy or Consulate in that country. Once the physical or attested SPA reaches India via courier, it must be adjudicated, stamped, and registered locally in India (usually within 3 months of receipt) to have legal standing. Check with your Indian lawyer if your specific Family Court bench accepts video-identified or e-notarized documents, though physical consular attestation remains the safest route.
Q: convicted in lower court and RE IN appeal in session
Matter is pending for order. If we get again covicted in session , can we straight appeal in high court?
Advocate Sanjay Kumar Patel answered
Yes, if the Sessions Court dismisses your first appeal and upholds or confirms your conviction, you can file a second challenge directly in the High Court, but it is typically filed as a criminal revision petition rather than a direct second regular appeal. If Conviction is Confirmed: When the Sessions Court (acting as the first appellate court) dismisses your appeal and maintains the conviction, code procedures (under the CrPC / Bharatiya Nagarik Suraksha Sanhita, BNSS) generally bar a second regular appeal. The Correct Route: Instead of a straight appeal, your remedy is to file a Criminal Revision Petition (under Section 397/401 of the CrPC or corresponding BNSS provisions) or approach the High Court under its inherent powers to challenge the appellate order. As Par Case
